Proposed Bylaw and House Rules changes
The House Rules Committee proposes the following amendment (in red) to the By-Laws and House Rules of the Deep Creek Lodge #2763 of the Benevolent and Protective Order of Elks of the United States of America:
Proposal to amend House Rule 4-Bar Operations: Amended Bar Operations would read as follows(striking entire subsection 'F')
Rule 4: Bar Operations
A. Only Elks in good standing are permitted to purchase beverages after showing their current Membership Card to the Bartender.
B. All alcoholic beverages must be purchased at the Club. No one is allowed to bring alcoholic beverages on the Lodge premises or into the Lodge building. Only alcoholic or non-alcoholic beverages in plastic cups may be taken outside the Lodge building; and then only on the premises immediately adjoining the Lodge building. This includes the smoking patio, horseshoe pits and all other outdoor activities.
C. The over service or consumption of alcohol as defined by local law or ordinance is strictly prohibited; this rule shall be applicable to all Members, Officers, and employees of the Lodge pursuant to Grand Lodge Statute 17.052.
The Lodge Officers, Supervising/Managing Body and Bartenders have the legal responsibility to determine if any Elk Member and/or guest has reached a degree of intoxication that dictates the discontinuance of further alcoholic beverages and to insure that such persons be refused any further service of alcoholic beverages; and that they not be provided by any other party.
Steps must be taken to insure that no such party be allowed to leave the premises without a sober driver, or if not, by calling his/her home for someone to take such party home, or call a cab to take the party home.
D. Only persons authorized by Bar staff on duty are permitted behind the bar.
E. No person under age twenty one (21) shall be allowed at the bar.
F. All games of chance must be conducted by Elk volunteers. No paid employee, including Bartenders, is
allowed to handle any type of game of chance ticket.

Purpose: To provide clarity and continuity between The Laws of the Order and the Bylaws of this Lodge.
Motion was made at the Lodge meeting on September 05, 2024 to lay over for a vote at the next regular lodge meeting on October 17, 2024 at the regular meeting time.
